The EPFO Amnesty Scheme for PF Trusts: what happened?
Some employers run their own PF trusts that the tax department already accepts, yet EPFO never issued a formal exemption order. Amnesty is a one-time door to fix that before the window shuts.
- EPFO is running a nationwide drive under the Amnesty Scheme, 2026 so that PF Trusts recognised under the Income Tax Act, 1961 but without a formal exemption order under section 17 of the EPF&MP Act, 1952 (or section 143 of the Code on Social Security, 2020) can regularise their status.
- Amnesty provisions sit in the Employees’ Provident Fund Scheme 2026, notified on 29 June 2026; guidelines came on 11 July 2026. The six-month window closes on 28 December 2026.
What does Amnesty offer?
- Retrospective regularisation of exempt status.
- Waivers of some Code on Social Security, 2020 conditions: minimum employee headcount, corpus size, and the 3-year compliance rule.
- After regularisation, the establishment may continue as exempt or move to unexempt coverage.
How is EPFO spreading the word?
- Meetings with CII, ICAI and BSE; outreach to Chartered Accountants and auditors; zonal and regional seminars; data sharing with the Income Tax Department to find unnotified trusts.
Why does the EPFO Amnesty Scheme for PF Trusts matter?
- Workers: Clearer legal cover for savings already parked in a trust.
- Compliance: Brings tax-recognised trusts under EPFO’s exemption map.
- Industry: A time-bound exit from a grey zone without reopening old defaults one by one.
