The Forest Rights Act regional review: what happened?
The Forest Rights Act, 2006 recognises the rights of forest-dwelling Scheduled Tribes and other traditional forest dwellers over land and forest resources. Claims start in the Gram Sabha and pass through sub-divisional and district committees. Many are still pending years later, so the Ministry has begun State-group reviews.
- First Regional Review Conference on FRA held at Bengaluru with Tribal Welfare, Revenue and Forest officials of five southern States.
- National status on 30 June 2026: over 54 lakh IFR claims, about 25.42 lakh titles over nearly 238 lakh acres, over 10 lakh pending, 19,845 CFRs.
- States asked for time-bound disposal of claims, CFR Resource rights, PVTG habitat rights and entry of rights in land records.
- A national FRA Portal is being developed; States urged to link their records through APIs.
- The Secretary cited a joint MoTA-MoEFCC advisory to fit Community Forest Resource Management Plans into forest working plans.
What kinds of rights does FRA recognise?
- Individual Forest Rights (IFR): over land a family occupies and cultivates.
- Community Forest Rights (CFR) and Community Forest Resource Rights (CFRR): over forests a community uses and protects; they support Gram Sabha-led forest governance.
- Habitat rights of Particularly Vulnerable Tribal Groups (PVTGs), which the Secretary said must be recognised with sensitivity and community participation.
Which constitutional provisions apply?
- Article 244(1): the Fifth Schedule applies to the administration and control of Scheduled Areas and Scheduled Tribes in States other than Assam, Meghalaya, Tripura and Mizoram.
- Article 342: the President may specify the tribes or tribal communities deemed to be Scheduled Tribes.
- Seventh Schedule, List III, Entry 17A: Forests.
