On 10 September 2026 the Department of Consumer Affairs amended the Consumer Protection (E-Commerce) Rules, 2020. The new rules make every e-commerce entity join the National Consumer Helpline convergence process, label sponsored listings, show a fair “prior price” for discounts and self-audit for dark patterns. They come into force on 1 January 2027.

The E-Commerce Rules amendment, 2026: what happened?
Online shopping has brought new tricks: fake urgency timers, buried fees, ads dressed up as search results. The 2020 rules set the base. The 2026 amendment closes several gaps the Government saw in complaints, while trying not to burden platforms more than needed.
- Every e-commerce entity must become a partner in the convergence process of the National Consumer Helpline (NCH).
- A complainant must get a copy of the complaint as recorded by the platform’s grievance officer.
- Search results must not be manipulated to mislead users; sponsored listings need clear and prominent labels.
- For a price cut, both the reduced price and the prior price must be shown.
- Platforms must follow the Dark Patterns Guidelines, 2023, do a yearly self-audit and display a compliance certificate.
- The rules come into force on 1 January 2027.
What changes for marketplaces?
| Area | New rule |
|---|---|
| Seller and product information | best before/use before dates, return/refund, warranty, delivery and payment details |
| Consumer data | not used for specified purposes without express and affirmative consent |
| Bundled fees | no fees for services unrelated to the platform (exception: loyalty or membership programmes) |
| Imported goods | importer details and country of origin to be disclosed |

Why was the National Consumer Helpline brought in?
- In 2025 the NCH received 17,71,622 grievances.
- Of these, 5,11,196, around 29 per cent, were about e-commerce.
- Linking every platform to NCH convergence means a complaint can move to the company quickly, instead of the buyer chasing it alone.
Which law is this made under?
- The Consumer Protection (E-Commerce) Rules, 2020 were notified under the Consumer Protection Act, 2019.
- The 2026 changes are made by amending those Rules, not the Act.
- The Guidelines for Prevention and Regulation of Dark Patterns, 2023 are now tied to the Rules through a yearly self-audit.
What do the complaint numbers show?
| Item | Number |
|---|---|
| Total grievances | 17,71,622 |
| E-commerce grievances | 5,11,196 |
| Share of e-commerce | around 29 per cent |
How does the “prior price” rule work?
- Platform announces a price reduction
- It must show the reduced price and the prior price together
- Prior price = lowest price of that item in the 30 days before the announcement
- A buyer can see the real size of the discount
Why does the E-Commerce Rules amendment, 2026 matter?
| Angle | What to note |
|---|---|
| Consumer rights | Discounts, ads and fees become easier to read for the buyer. |
| Grievance redress | Every platform joins NCH convergence; about 29 per cent of NCH complaints in 2025 were about e-commerce. |
| Data protection | Use of consumer information for specified purposes needs express and affirmative consent. |
| Ease of doing business | The Department says the rules avoid unnecessary burdens and give platforms clarity. |
| Level playing field | Clear rules on search results and sponsored listings help smaller sellers too. |
What are the challenges in the E-Commerce Rules amendment, 2026?
