Quick answerThe Preamble is the introduction to the Constitution. It says the Constitution’s authority comes from “We, the people of India”, describes India as a Sovereign Socialist Secular Democratic Republic, and lists its aims: justice, liberty, equality and fraternity. It is part of the Constitution (Kesavananda Bharati, 1973) but is not enforceable in court.

Background: from the Objectives Resolution to the Preamble

The Preamble began life as the Objectives Resolution, moved by Jawaharlal Nehru in the Constituent Assembly on 13 December 1946 and adopted on 22 January 1947. It declared India an independent sovereign republic and promised justice, equality and freedom to all its people. The Drafting Committee turned this into the Preamble, but the Assembly debated and adopted it only at the very end, after the rest of the text was settled, so that it would faithfully reflect what the Constitution actually contained. Proposals to begin with “In the name of God” or to add “Gandhian” were put to vote and rejected. The Constitution was adopted on 26 November 1949, the date the Preamble itself records.

What is the Preamble of the Indian Constitution?

The Preamble is based on the Objectives Resolution moved by Jawaharlal Nehru in the Constituent Assembly on 13 December 1946 and adopted on 22 January 1947. It does three jobs: it names the source of authority (the people), states the nature of the Indian state, and sets out the objectives the rest of the Constitution tries to achieve. It records the date of adoption, 26 November 1949.

Is the Preamble part of the Constitution?

In the Berubari Union reference (1960) the Supreme Court said the Preamble is not a part of the Constitution, though it is a key to interpreting it. In Kesavananda Bharati v. State of Kerala (1973) the Court held that it is a part, and can be amended under Article 368 provided the basic structure is not destroyed. LIC of India v. Consumer Education & Research Centre (1995) reaffirmed this.

Why is the Preamble non-justiciable?

The Preamble creates no powers and imposes no duties, so a court cannot enforce it on its own. It neither grants power to the legislature nor limits it. Courts use it to resolve ambiguity in the operative provisions. That is why it is described as the “philosophy” or “soul” of the Constitution rather than a source of rights.

Amendment of the Preamble: the 42nd Amendment

The Preamble has been amended once. The 42nd Amendment Act, 1976 added “Socialist”, “Secular” and “Integrity” (“unity of the Nation” became “unity and integrity of the Nation”). In Dr Balram Singh v. Union of India (2024) the Supreme Court dismissed challenges to the insertion of “socialist” and “secular”. The Court held that the amending power under Article 368 extends to the Preamble, and that “socialist” signals a welfare state rather than a fixed economic model.

Why the Preamble is important

It is the shortest statement of what the Constitution is for. In the basic structure cases the Court read the Preamble’s values (sovereignty, democracy, secularism, justice) as clues to which features Parliament cannot destroy. Mains answers that start from the Preamble’s words score well on “values” questions in GS-II and GS-IV.

What the courts have said

The Supreme Court has changed its mind on the Preamble’s status. In the Berubari Union reference (1960) it said the Preamble is not part of the Constitution, though it is a key to understanding the framers’ minds. In Kesavananda Bharati (1973) a larger bench held that it is part of the Constitution and can be amended, subject to the basic structure. LIC of India v Consumer Education and Research Centre (1995) repeated that it is an integral part. In S.R. Bommai (1994) the Court read “secular” in the Preamble as a basic feature. The Preamble cannot create rights or override clear text, but where a provision is ambiguous, judges use it to pick the meaning that best fits its values.

Borrowed ideas, Indian synthesis

The opening words echo the United States Constitution (“We the People”). The language of a sovereign democratic republic and of liberty, equality and fraternity owes much to the French Revolution, and the idea of justice that is social, economic and political is linked to the Russian Revolution. Australia’s Constitution influenced the idea of a preamble that sets out a constitutional vision. What is Indian is the combination: fraternity is tied to “the dignity of the individual and the unity and integrity of the Nation”, a pairing suited to a diverse, newly independent country.

Debates for Mains

  • Socialist and secular: critics argue the words were added during the Emergency without real debate; supporters reply that both ideas were already present in Parts III and IV. The Court has upheld them.
  • Justiciability: a non-enforceable Preamble still shapes interpretation, so it is far from decorative.
  • Fraternity: often called the forgotten value; Ambedkar warned that liberty and equality cannot survive without it.
