The stem cell therapy advisory: what happened?
Stem cells are being tried for many illnesses, but only a few uses are proven. The worry is clinics offering unproven stem cell treatment, including for autism, as a routine paid service. The Supreme Court ruled on this in January 2026, and the Ministry has now spelt out the rules.
- Stem cell therapy as routine, standard care only for indications on the Ministry-approved list.
- For Autism Spectrum Disorder, any type of stem cell use stays restricted to approved clinical trials.
- Unproven stem cell interventions must not be offered as routine, standard or commercial services.
- States and UTs must pass the Court’s directions to State and District authorities and to all clinics in this field.
What penalties apply?
- The Supreme Court (Para 151(xiii)) said non-compliance must have consequences.
- Doctors: professional misconduct under Regulation 7.22 of the IMC Regulations, 2002.
- Clinics: action under Sections 32 and 40 of the Clinical Establishments Act, 2010, which provide for penalty and cancellation of registration.
What did the NMC say?
- Its advisory of 5 September 2026 says stem cell therapy may be standard care only for approved indications.
- Unauthorised giving, prescribing, promoting or advertising beyond them is professional misconduct.
- State Medical Councils should examine complaints and act after due process.
Which constitutional provisions apply?
- Seventh Schedule, List II, Entry 6: public health and sanitation; hospitals and dispensaries. So clinics are mainly regulated by States, and the Clinical Establishments Act, 2010 applies in States that adopt it.
- Article 47: the State shall regard the raising of the level of nutrition and the standard of living of its people and the improvement of public health as among its primary duties.
How is stem cell use now split?
- Condition on Ministry-approved list: may be standard care
- Condition not on the list: not to be offered as routine or commercial service
- Autism Spectrum Disorder: only in approved clinical trials
- Violation: misconduct (doctor) or penalty and cancellation (clinic)

What are the challenges in the stem cell therapy advisory?
- The advisory applies to States and UTs that have adopted the Clinical Establishments Act, 2010; enforcement elsewhere depends on State laws.
- Clinics may relabel treatments to escape the rules.
- Families of autistic children need support so that they are not drawn to unproven cures.
- District authorities need staff to inspect private clinics.
What should be done next on the stem cell therapy advisory?
- Publish the approved list widely so that patients can check.
- Take action on complaints through State Medical Councils.
- Fund proper clinical trials so that real treatments can be found.
