The Azam Khan case: what happened?

Money laundering cases begin with another crime. Here, the alleged crime is land grabbing from farmers in Rampur.

  • A special Prevention of Money Laundering Act court in Ghaziabad sent Azam Khan to 14-day judicial custody on Sunday.
  • The Enforcement Directorate’s probe rests on 26 First Information Reports filed by Uttar Pradesh Police in July 2019.
  • The charge: farmers’ land in Singankhera village, Rampur, was occupied for Mohammad Ali Jauhar University.
  • Farmers were allegedly forced through assault, unlawful confinement and threats to sign sale deeds.
Back Story

How does the money-laundering law work?

The Prevention of Money Laundering Act, 2002 (PMLA) punishes hiding or using money made from crime, called ‘proceeds of crime’.

PMLA works on top of a ‘scheduled offence’, such as fraud or extortion, registered by another agency. The money-laundering case cannot stand without it.

The Enforcement Directorate (ED), under the Department of Revenue in the Ministry of Finance, investigates PMLA cases. It also enforces the Foreign Exchange Management Act, 1999.

In Vijay Madanlal Choudhary (2022), the Supreme Court upheld the ED’s powers of arrest and attachment and the strict bail conditions under Section 45.
