Forest Rights Act implementation: what happened?

FRA is twenty years old, yet a fifth of all claims are still pending and a third have been rejected. The ministry is now reviewing States region by region; the first meeting was in Bengaluru on 10 September 2026 for the southern States.

  • Eight States reviewed pending claims, entry of rights into revenue and forest records, Community Forest Resource Rights (CFRR) and PVTG habitat rights.
  • Andhra Pradesh shared its digitisation and integration of FRA titles; Odisha and Chhattisgarh were noted for PVTG habitat rights.
  • States were asked for district-wise, time-bound plans and to integrate their records with the national FRA portal through APIs.
  • Madhya Pradesh, Odisha and Assam have large pendency in particular districts.
Back Story

What rights does the Forest Rights Act give?

  • Individual Forest Rights (IFR): rights over forest land under occupation and cultivation.
  • Community rights, including Community Forest Resource Rights: the community’s right to protect, regenerate and manage its customary forest.
  • Habitat rights for Particularly Vulnerable Tribal Groups (PVTGs).
  • The Gram Sabha starts the process of deciding the nature and extent of rights.
Back Story

Why do recognised rights need to reach records?

  • A title on paper helps little if revenue and forest records do not show it. Updated records let right-holders get credit, scheme benefits and protection against eviction. The ministry issued an advisory on this on 24 June 2026; habitat-rights guidelines came on 5 January 2026.
Rulebook

Which constitutional ideas support FRA?

  • Article 244 and the Fifth Schedule provide for administration of Scheduled Areas.
  • Article 46 (Directive Principle) asks the State to promote the educational and economic interests of Scheduled Tribes and protect them from injustice.

GovernanceDigitisation and APIs reduce data gaps and delays.
Fault Lines

What are the challenges in Forest Rights Act implementation?

  • High rejection (over 18 lakh) raises questions about how claims were examined; review of rejections is a stated priority.
  • Pendency is concentrated in a few districts of MP, Odisha and Assam.
  • CFR rights need Gram Sabha capacity to actually manage forests.
Road Ahead

What should be done next on Forest Rights Act implementation?

  • Time-bound disposal and review of rejected claims as per the Act and Rules.
  • Fund Gram Sabha capacity for CFR management plans (support available under DA-JGUA).
  • PVTG-wise habitat-rights roadmaps with traditional institutions.
