US Section 301 forced-labour tariffs on India: what happened?
Section 301 lets the United States act against what it calls unfair foreign practices. This probe looked at how countries ban imports made with forced labour. India engaged through written submissions, in-person consultations and public hearings, and ended in the lower tariff tier.
- Generic pharmaceuticals, smartphones and certain other products that already face zero additional US duties stay outside the extra 10%.
- Goods already under Section 232 (steel, aluminium, auto parts) are not hit by the extra 10%; Section 232 applies broadly with limited exceptions.
- A textile-specific mechanism in the final measures is not yet set up.
- India is talking to the US on that mechanism inside the India-US Bilateral Trade Agreement talks, announced on 2 February 2026 and backed by a Joint Statement on 7 February 2026.
What is Section 301?
- A provision of the U.S. Trade Act, 1974 that allows unilateral measures against unfair acts, policies or practices of trading partners.
- Here it was used after a forced-labour enforcement investigation covering 60 economies, including India.
- The probe looked at how each economy imposes and enforces prohibitions on importing goods produced with forced labour.
How does Section 232 differ?
- Section 232 duties on steel, aluminium and auto parts apply broadly to all countries with limited exceptions.
- Those products are carved out of the extra Section 301 10% duty, so exporters already paying Section 232 are not hit twice by this measure.
Where does the Bilateral Trade Agreement fit?
- India and the United States announced BTA negotiations on 2 February 2026 and issued a Joint Statement on 7 February 2026.
- The Commerce Ministry says India is still engaging the US on the textile-specific mechanism inside those talks.
How much of India’s US trade is hit?
| Slice | Share / treatment |
|---|---|
| Outside the extra 10% duty | About 45% of India’s US exports |
| Inside the extra 10% duty | About 55% |
| Carve-outs named | Generics, smartphones, other specified products; Section 232 goods |
| Proposed rate (2 Jun 2026) | 12.5% |
| Final rate | 10% |

| Diplomacy | Outcome tied to BTA talks with the United States. |
| Sectors | Pharma and smartphones shielded; textiles mechanism still pending. |
