UPSC Mains 2022 GS Paper 4 Q6a: model answer
Whistle-blower, who reports corruption and illegal activities, wrongdoing and misconduct to the concerned authorities, runs the risk of being exposed to grave danger, physical harm and victimization by the vested interests, accused persons and his team. What policy measures would you suggest to strengthen protection mechanism to safeguard the whistle-blower?
What the question wants
Suggest policy measures to strengthen protection for whistleblowers who face danger and victimisation.
How to structure it
Problem, current law, gaps, measures.
- Risk
- WBP Act 2014
- Gaps
- Measures
How to think it through
Satyendra Dubey 2003, Manjunath 2005, RTI activists killed; Vyapam whistle-blowers and deaths. WBP Act 2014 enacted, not operationalised; 2015 amendment bill (diluting with OSA exemptions) lapsed. PIDPI resolution 2004 (CVC designated). Measures: operationalise law, independent authority, anonymity and secure digital channels, physical protection, protection from transfers/adverse APAR (reverse burden of proof), legal aid, time-bound inquiry, rewards, extend to private sector (SEBI informant mechanism 2019 rewards), penalties for victimisation, culture.
Model answer
In 2003, Satyendra Dubey reported highway corruption to the PMO and asked for secrecy. His identity leaked, and he was killed.
The current framework
- The PIDPI Resolution (2004) made the CVC the authority to receive complaints and protect identity.
- The 2014 Act provides for confidentiality and protection; a 2015 amendment bill that would have narrowed it lapsed.
Gaps
- Law not in force; protection depends on discretion.
- Weak protection from transfers, adverse reports and harassment.
Policy measures I would suggest
- Operationalise the 2014 Act with clear rules and timelines.
- Secure, anonymous digital channels for complaints.
- Physical protection where threats exist, with police accountability.
- Reverse burden of proof: if a whistleblower faces adverse action, the employer must prove it is unrelated.
- Time-bound inquiries and legal aid.
- Penalties for leaking identity or victimising whistleblowers.
- Rewards: SEBI's informant scheme (2019) offers rewards for reporting insider trading; similar incentives can work elsewhere.
Culture
- Leaders must treat whistleblowers as allies of the institution, not traitors.
A country that cannot protect its whistleblowers is telling the corrupt they are safe.
Draw: A shield over the whistleblower with layers: identity, physical safety, career, legal aid.
