UPSC Mains 2014 GS Paper 2 Q4: model answer
What do you understand by the concept “freedom of speech and expression”? Does it cover hate speech also? Why do the films in India stand on a slightly different plane from other forms of expression? Discuss.
What the question wants
Define free speech, say whether it covers hate speech, and explain why films are treated differently.
How to structure it
Three questions in one: meaning, hate speech, films. Give each roughly equal space.
- Meaning and limits
- Hate speech
- Films
- Balance
How to think it through
A newspaper is read alone; a film is watched in a dark hall by hundreds together. The Supreme Court used almost that reasoning in 1970. That one image explains why censorship applies to films but not books.
Model answer
India's Supreme Court called free speech the 'first condition of liberty' in Romesh Thappar (1950), yet the First Amendment of 1951 added restrictions within a year. The tension has never gone away.
Meaning
Article 19(1)(a) protects speech, writing, the press (Romesh Thappar, Sakal Papers), the right to information, silence (Bijoe Emmanuel, 1986), and, after Shreya Singhal (2015), online expression. Article 19(2) allows reasonable restrictions on eight grounds.
Does it cover hate speech?
No. Hate speech targets groups by religion, caste, race or ethnicity and can incite violence.
- It falls within restrictions for public order, decency, and incitement.
- Penal provisions: Sections 153A and 295A of the IPC (now Sections 196 and 299 of the Bharatiya Nyaya Sanhita), and Section
123(3A) of the Representation of the People Act.
- In Pravasi Bhalai Sangathan (2014), the Court asked the Law Commission to define hate speech; its 267th Report (2017) suggested new offences.
Why films stand apart
- K.A. Abbas v Union of India (1970): films move audiences more strongly than print because they combine sight and sound.
- Hence pre-censorship by the Central Board of Film Certification under the Cinematograph Act, 1952.
- Yet courts protect films from mobs and bans: S. Rangarajan (1989) said the state must protect a film, not ban it; Padmaavat (2018) was allowed across states.
Balance
Speech needs wide protection; hate speech needs clear, narrow law; and film certification should be about age ratings, not political comfort.
Draw: Venn diagram: protected speech, hate speech, film certification zone.

Census 2027: can private teachers be made enumerators? The Census Rules amendment and Article 23
Census 2027 needs over 30 lakh enumerators, the people who go door to door counting everyone.
