What the question wants

  1. The issue
  2. Article 15(5) and 30
  3. NCSC's powers
  4. Courts
  5. Conclusion

How to think it through

This came from a real dispute: NCSC notices to Aligarh Muslim University and Jamia Millia Islamia over SC quotas. The answer turns on two points: minority institutions are exempt under Article 15(5), and the NCSC has no enforcement power anyway.

Model answer

In 2018 the NCSC asked Aligarh Muslim University why it did not reserve seats for Scheduled Castes. The question touches two constitutional promises at once.

The law

  • Article 15(5) permits reservation in educational institutions but expressly excludes minority institutions under Article 30(1).
  • Pramati Educational Trust (2014) upheld this exclusion.
  • Jamia was declared a minority institution by the NCMEI in 2011; AMU's status was clarified in 2024, when a seven-judge bench overruled Azeez Basha and left the question to a regular bench.

NCSC's powers

  • Article 338 lets it investigate, inquire into complaints and summon like a civil court.
  • But it cannot enforce; it reports to the President and recommends. Only Parliament, the executive or the courts can compel an institution to reserve seats.

Conclusion

Where an institution is a recognised minority institution, reservation for SCs cannot be imposed, so the NCSC cannot enforce it. Where minority status is doubtful, it can inquire and refer the matter to government and courts. Its real leverage is publicity and its report to Parliament.

Draw: Two overlapping circles, Article 15(5) and Article 30(1), with minority institutions in the exempt zone.

Census 2027: can private teachers be made enumerators? The Census Rules amendment and Article 23

Census 2027 needs over 30 lakh enumerators, the people who go door to door counting everyone. This month the Centre amended the Census Rules, 1990 to name teachers of private schools and staff of banks and companies as possible enumerators. But two High Courts had already stopped governments from forcing private-school teachers into Census duty. For you, it raises a classic exam question: can a rule make private citizens do public work, and what do the Census Act and Article 23 allow?
