National Biodiversity Authority

The National Biodiversity Authority (NBA) is a statutory body established by the Central Government under Section 8 of the Biological Diversity Act, 2002. Its head office is at Chennai (Biological Diversity Act, Section 8(3)). States have State Biodiversity Boards, and local bodies have Biodiversity Management Committees.

The Central Pollution Control Board (CPCB) is a statutory organisation constituted in September 1974 under the Water (Prevention and Control of Pollution) Act, 1974. It was later also given powers and functions under the Air (Prevention and Control of Pollution) Act, 1981, and gives technical services to the Environment Ministry (cpcb.nic.in). State Pollution Control Boards (SPCBs) do the same work in each State under the same two Acts, issuing consents to establish and operate.

National Green Tribunal

The National Green Tribunal (NGT) was established on 18 October 2010 under the National Green Tribunal Act, 2010, for effective and quick disposal of cases on environmental protection and conservation of forests and other natural resources, including relief and compensation for damage. It is guided by the principles of natural justice and is not bound by the Code of Civil Procedure. It must try to dispose of applications or appeals within 6 months of filing. New Delhi is the principal place of sitting; Bhopal, Pune, Kolkata and Chennai are the other four (greentribunal.gov.in).

The National Green Tribunal Act, 2010 was enacted in consonance with the Right to healthy environment, construed as a part of Right to life under Article 21 (Prelims 2012: 1 only).

Q1 · Battle IAS practice

Under the National Green Tribunal Act, 2010, who among the following can make an application to the Tribunal for relief or settlement of a dispute?
1. Any person aggrieved, including a representative body or organisation
2. A State Pollution Control Board
3. A State Government
Select the correct answer using the code given below.

Answer (c) & explanation

All three can apply. Section 18(2) allows an application by the injured person, the owner of damaged property, legal representatives, an agent, any person aggrieved, including any representative body or organisation, and also by the Central or a State Government, a Union territory administration, the CPCB, a State Pollution Control Board, a pollution control committee, a local authority or an environmental authority. This broad standing is what makes public-interest environmental litigation possible before the NGT.

Q2 · Battle IAS practice

In India, 'Pollution Control Committees' (such as the Delhi Pollution Control Committee) perform the role that State Pollution Control Boards perform elsewhere. Where do they function?

Answer (a) & explanation

They function in Union territories. Under Section 4(4) of the Water Act (and the matching provision of the Air Act), no State Board is constituted for a Union territory; the Central Board exercises a State Board's powers there and may delegate them to a body specified by the Central Government. These delegated bodies are the Pollution Control Committees, e.g. the Delhi Pollution Control Committee.

Q3 · Battle IAS practice

Under the National Green Tribunal Act, 2010, an application seeking compensation for victims of pollution or restitution of the damaged environment ordinarily has to be filed within what period from the date on which the cause for such relief first arose?

Answer (d) & explanation

The answer is five years. Section 15(3) bars an application for relief, compensation or restitution unless it is made within five years of the date the cause first arose; the Tribunal may allow a further sixty days for sufficient cause. The shorter limits belong to other provisions: six months for disputes under section 14 and thirty days for appeals under section 16.

Q4 · Battle IAS practice

With reference to the pollution control boards under the Water (Prevention and Control of Pollution) Act, 1974, consider the following statements:
1. Two or more contiguous States may, by agreement, constitute a Joint Board for their territories.
2. The Central Board can lay down standards for a stream or well, in consultation with the State Governments concerned.
3. The members of a State Pollution Control Board are nominated by the Central Pollution Control Board.
Which of the statements given above is/are correct?

Answer (b) & explanation

Statements 1 and 2 are correct. Section 13 of the Water Act allows the governments of two or more contiguous States (or a State and a Union territory) to agree to set up a Joint Board. Under Section 16(2)(h) the Central Board, in consultation with the State Governments concerned, lays down, modifies or annuls standards for a stream or well. Statement 3 is wrong: a State Board is constituted by the State Government (section 4), which nominates its chairman and members; the CPCB coordinates and advises State Boards but does not appoint them.

Q5 · Battle IAS practice

With reference to the National Green Tribunal Act, 2010, consider the following statements:
1. Its Preamble refers to the decisions taken at the United Nations conferences held at Stockholm in 1972 and at Rio de Janeiro in 1992.
2. It repealed the National Environment Tribunal Act, 1995 and the National Environment Appellate Authority Act, 1997.
3. Cases pending before the National Environment Appellate Authority on the establishment of the Tribunal stood transferred to the Supreme Court.
Which of the statements given above is/are correct?

Answer (a) & explanation

Statements 1 and 2 are correct. The Preamble of the Act recalls India's participation in the Stockholm (1972) and Rio (1992) conferences, which called on States to provide judicial redress and compensation for environmental damage, and notes that the right to a healthy environment is part of Article 21. Section 38 repealed the National Environment Tribunal Act, 1995 (never effectively enforced) and the National Environment Appellate Authority Act, 1997. Statement 3 is wrong: pending cases of the Appellate Authority were transferred to the NGT itself, not to the Supreme Court.

Q6 · Battle IAS practice

In which one of the following judgments did the Supreme Court hold that the National Green Tribunal can take up environmental matters on its own motion (suo motu), even without a formal application?

Answer (b) & explanation

In Municipal Corporation of Greater Mumbai v. Ankita Sinha (7 October 2021), a three-judge Bench held that the NGT is a sui generis forum with a wide remedial role and can act suo motu, for instance on letters or news reports, to protect the environment. The other cases laid down substantive doctrines rather than the Tribunal's procedural power.

Q7 · Battle IAS practice

With reference to the National Air Quality Monitoring Programme (NAMP) run by the Central Pollution Control Board, consider the following statements:
1. It is executed through the Central Board, the State Pollution Control Boards, Pollution Control Committees and some other institutions.
2. Sulphur dioxide, nitrogen dioxide, PM10 and PM2.5 are the pollutants identified for regular monitoring at all locations.
3. All NAMP stations are continuous automatic stations reporting data every fifteen minutes.
Which of the statements given above is/are correct?

Answer (a) & explanation

Statements 1 and 2 are correct. NAMP is a nationwide network run by the CPCB with State Boards, Pollution Control Committees and research institutions. Four pollutants — SO2, NO2, PM10 and PM2.5 — are identified for regular monitoring at all locations. Statement 3 is wrong: NAMP stations are largely manual stations, where 24-hour samples are taken twice a week (giving about 104 observations a year); real-time data come from a separate network of Continuous Ambient Air Quality Monitoring Stations (CAAQMS).

Q8 · Battle IAS practice

With reference to the Commission for Air Quality Management in National Capital Region and Adjoining Areas, consider the following statements:
1. An appeal against its order or direction lies to the National Green Tribunal.
2. In case of conflict, its orders and directions prevail over those of the State Pollution Control Boards of the region.
3. A civil court can entertain a suit questioning any direction issued by the Commission.
Which of the statements given above is/are correct?

Answer (c) & explanation

Statements 1 and 2 are correct. Under Section 18 of the CAQM Act, 2021, appeals against the Commission's orders, directions or actions lie to the National Green Tribunal. Section 3(6) gives the Commission exclusive jurisdiction over matters covered by the Act in the NCR and adjoining areas, and its directions prevail over conflicting orders of the State Governments, the CPCB and the State Boards. Statement 3 is wrong: Section 22 bars civil courts from entertaining suits or proceedings arising from the Commission's actions or directions.
