Water, Air and Environment (Protection) Acts

India’s pollution laws grew in three steps. The Water (Prevention and Control of Pollution) Act, 1974 created the pollution control boards. The Air (Prevention and Control of Pollution) Act, 1981 gave them powers over air. The Environment (Protection) Act, 1986 is an umbrella law that lets the Centre set standards and issue rules and notifications.

Forest law and the National Forest Policy

The Forest (Conservation) Act, 1980 requires prior permission of the Central Government for de-reserving reserved forests, using forest land for non-forest purposes, leasing forest land to private entities, and clearing naturally grown trees for reafforestation. After the Supreme Court judgment of 12 December 1996 it was applied also to land recorded as forest and areas that look like forest in the dictionary sense (PIB, 26 July 2023).

The Forest (Conservation) Amendment Act, 2023 renamed the law the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980, and the Van (Sanrakshan Evam Samvardhan) Rules, 2023 set out the approval procedure (PIB, 7 December 2023).

Forest dwellers’ rights sit in a separate law. The definition of “Critical Wildlife Habitat” is incorporated in the Forest Rights Act, 2006, and Baigas were the first community in India to be given Habitat Rights; Habitat Rights are not declared by the Union Environment Ministry (Prelims 2018: 1 and 2 only).

Q1 · Battle IAS practice

The Indian Forest (Amendment) Act, 2017 was enacted mainly to

Answer (a) & explanation

The amendment, first issued as an ordinance in November 2017, changed section 2(7) of the Indian Forest Act so that bamboo grown in non-forest areas is no longer a 'tree'. Bamboo is botanically a grass, and the change freed farmers from felling and transit permits, aiming to raise farm incomes and bamboo-based industry. Bamboo in forest areas remains regulated. The CAF came from a separate 2016 Act, and MFP ownership and community forest resources come from the Forest Rights Act, 2006.

Q2 · Battle IAS practice

Which one of the following was added by the 2023 amendment to the list of activities that are NOT treated as a 'non-forest purpose' under the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980?

Answer (b) & explanation

The 2023 amendment added zoos and safaris owned by the Government or any authority (in forest areas outside protected areas), eco-tourism facilities, silvicultural operations and other purposes notified by the Centre to the activities excluded from 'non-forest purpose'. Works such as check posts, fire lines, fencing and wireless communication were already excluded under the original Explanation to section 2. Cultivation of tea, coffee, rubber or medicinal plants is expressly a non-forest purpose, and mining always needs prior approval.

Q3 · Battle IAS practice

With reference to the Forest (Conservation) Amendment Act, 2023, consider the following statements:
1. It renamed the Forest (Conservation) Act, 1980 as the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980.
2. It inserted a preamble that refers to India's target of net zero emissions by 2070.
3. It provides that the Act does not apply to land whose use was changed from forest to non- forest purposes on or before 12 December 1996 by an authority authorised by a State or Union territory.
Which of the statements given above are correct?

Answer (d) & explanation

All three are correct. The amending Act (passed in August 2023, in force from 1 December 2023) renamed the law as the Van (Sanrakshan Evam Samvardhan) Adhiniyam, and added a preamble linking forest conservation to the net zero by 2070 goal, the NDC carbon-sink target and raising forest and tree cover. Its new section 1A limits coverage to land notified as forest under the Indian Forest Act or other laws and land recorded as forest in government records on or after 25 October 1980, and excludes land changed to non-forest use on or before 12 December 1996, the date of the Godavarman order.

Q4 · Battle IAS practice

With reference to the Compensatory Afforestation Fund Act, 2016, consider the following statements:
1. It establishes a National Compensatory Afforestation Fund under the public account of India and a State Fund under the public account of each State.
2. Ninety per cent of the money collected by a State is credited to its State Fund, and ten per cent to the National Fund.
3. The money collected includes the net present value of the forest land diverted for non-forest purposes.
Which of the statements given above are correct?

Answer (d) & explanation

All three are correct. The Act placed funds that had piled up in the ad hoc CAMPA account into the public accounts of India and of each State, so they are no longer kept outside the government's books. Collections from user agencies for compensatory afforestation, net present value (NPV) of diverted forest land and other project-specific payments are split 90:10 between the State Fund and the National Fund. The Act also set up National and State authorities to manage the funds.

Q5 · Battle IAS practice

Under section 2 of the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980, the prior approval of the Central Government is required for which of the following?
1. An order of a State Government directing that a reserved forest shall cease to be reserved
2. Use of any forest land for any non-forest purpose
3. Cultivation of tea, coffee or rubber on forest land, which the Act treats as a forest purpose
Select the correct answer using the code given below.

Answer (a) & explanation

Items 1 and 2 need prior Central approval. Section 2 bars a State Government or other authority, without the Centre's prior approval, from (i) de-reserving a reserved forest, (ii) using forest land for a non-forest purpose, (iii) assigning forest land by lease to any entity, and (iv) clearing naturally grown trees for reafforestation. Item 3 is wrongly framed: the Explanation to section 2 expressly treats cultivation of tea, coffee, spices, rubber, palms, oil-bearing plants, horticultural crops or medicinal plants as a non-forest purpose, so such cultivation also needs approval, not because it is a forest purpose.

Q6 · Battle IAS practice

With reference to the Supreme Court's order of 12 December 1996 in T.N. Godavarman Thirumulpad v. Union of India, consider the following statements:
1. The term 'forest' was to be understood according to its dictionary meaning, covering any area recorded as forest in government records irrespective of ownership.
2. Non-forest activities going on in such forests without the Central Government's approval under the Forest (Conservation) Act were directed to cease.
Which of the statements given above is/are correct?

Answer (c) & explanation

Both are correct. In the Godavarman case (a continuing mandamus), the order of 12 December 1996 held that 'forest' must be understood in its dictionary meaning, covering all statutorily recognised forests and any area recorded as forest in government records, irrespective of ownership. It directed that all ongoing non-forest activities in such areas without prior Central approval under the 1980 Act must stop. The ruling extended the Act to 'deemed forests', which is why the 2023 amendment's narrower coverage was challenged.

Q7 · Battle IAS practice

Under the Van (Sanrakshan Evam Samvardhan) Adhiniyam, 1980 as amended in 2023, which of the following categories of forest land are exempted from the Act's requirement of prior approval, subject to the Central Government's terms and conditions?
1. Land within 100 km of international borders, the Line of Control or the Line of Actual Control, proposed for strategic linear projects of national importance concerning national security
2. Land up to 10 hectares proposed for security-related infrastructure
3. Land up to 5 hectares in a left-wing extremism affected area proposed for defence-related projects, paramilitary camps or public utility projects
4. Land up to 25 hectares proposed for a privately owned tourism resort
How many of the above are exempted?

Answer (c) & explanation

The first three are exempted under the new section 1A(2): strategic linear projects within 100 km of the border, LoC or LAC; security-related infrastructure up to 10 hectares; and defence, paramilitary or public-utility projects up to 5 hectares in LWE-affected areas. Also exempted are small strips along rail lines and public roads leading to habitations, and roadside amenities up to 0.10 hectare. There is no exemption for private tourism resorts; the amendment allows only eco-tourism facilities and government-run zoos and safaris (outside protected areas) as non-forest-purpose exclusions.

Q8 · Battle IAS practice

With reference to the Water (Prevention and Control of Pollution) Amendment Act, 2024, consider the following statements:
1. It applied in the first instance to Himachal Pradesh, Rajasthan and the Union territories, and other States may adopt it by resolution.
2. It empowers the Central Government, in consultation with the Central Pollution Control Board, to exempt certain categories of industrial plants from the requirement of prior consent for new outlets and discharges.
3. It replaced imprisonment for many violations with monetary penalties imposed by an adjudicating officer, whose orders can be appealed before the National Green Tribunal.
Which of the statements given above are correct?

Answer (d) & explanation

All three statements are correct. Because water is a State subject, the amendment (assent 15 February 2024) applied first to Himachal Pradesh, Rajasthan and the Union territories, whose legislatures had passed Article 252 resolutions; other States can adopt it. A new proviso to section 25 lets the Centre, in consultation with the CPCB, exempt categories of industrial plants from consent; this was used in November 2024 for white-category units. The Act also decriminalised many offences, replacing jail with penalties of ₹10,000 up to ₹15 lakh decided by an adjudicating officer (section 45B), with appeals to the NGT.
