Which Article of the Constitution of India safeguards one's right to marry the person of one's choice?
Answer (b) & explanation
Article 21 protects the right to marry a person of one's choice (b). In Shafin Jahan v. Asokan K.M. (2018), the Hadiya case, the Supreme Court set aside a Kerala High Court order that had annulled an adult woman's marriage. It held that the right to marry a person of one's choice is part of personal liberty under Article 21. Article 19 (a) covers freedoms such as speech and movement. Article 25 (c) protects freedom of religion. Article 29 (d) protects minorities' culture and language.
Notice the later cases: Shakti Vahini (2018), against khap panchayats and honour killings; and Supriya Chakraborty (2023), where the Court declined to legalise same-sex marriage, leaving it to Parliament.
